Terms and Conditions for Zomato Trivia (“Quiz Terms”)

By participating in Zomato Trivia (“Quiz”), you agree to be bound by the following Quiz Terms:

1. You acknowledge that except as specifically set out under these Quiz Terms, the terms of service, located at https://www.zomato.com/policies/terms-of-service/ (“Terms of Service”) shall apply mutatis mutandis to these Quiz Terms. The capitalized terms not defined under these Quiz Terms shall have the same meaning as assigned under the Terms of Service.
2. Participation in the Quiz is open to participants, residing in India, aged eighteen (18) years and above.
3. The Quiz will commence from October 19, 2023 and shall continue until October 24, 2023 (“Quiz Period”).
4. Only one entry per Quiz is allowed and the participant shall not use multiple devices to play the Quiz.
5. Participation on behalf of another participant will not be accepted and joint submissions are not allowed.
6. The participant acknowledges that the window for participating in the Quiz shall open one (1) hour prior to the Quiz and shall close one (1) minute before the Quiz starts.
7. The participant acknowledges that the participant will be asked three (3) questions in every Quiz window and the participant has to give answers to all the questions that are asked in the Quiz to win Rewards (as defined below). The number of Quiz questions may be revised at any point at Zomato’s sole discretion.
8. The participant acknowledges that once the answer for the question is entered and submitted, the participant will not be able to change the answer. The answer to the question will be visible after ten (10) seconds of submitting the answer by the participant.
9. For correct answers submitted by the participants, the participants may receive benefits in the form of coupons issued by partner restaurants or other partners of Zomato or receive certain other benefits which could be in the form of promo codes, instant discounts, marketing credits, vouchers or in such other manner as Zomato determines at its discretion (collectively referred to as “Reward(s)”). The terms and conditions, including the expiry date, of each Reward may vary for each Reward. Each of the Reward(s) will be subject to such conditions issued by Zomato or third-party partner brands, which can either be redeemed on the Zomato Platform or on the third-party partner brands platform, as the case may be, in accordance with the redemption terms and conditions of the respective Reward(s).
10. The participant acknowledges that the Reward(s) offered by third-party partner brands shall be redeemed on the respective website and/or mobile application of the said partner brand and the issue and use of such Reward(s) will be governed by the applicable terms and conditions of the respective partner brand.
11. The participant acknowledges that the Reward(s) value may vary for each Quiz and will be communicated to the participant before the start of each Quiz. The Reward(s) will be distributed equally by Zomato based on the number of participants who have answered the questions correctly.
12. The participant acknowledges that Zomato may deduct TDS from the Reward, if required as per applicable law. If required, the participant agrees to provide their Permanent Account Number (PAN) to Zomato for applicable TDS compliance.
13. The participant acknowledges that Zomato disclaims all responsibility and liability associated with the Reward(s) issued by third-party partner brands, including without limitation, any warranties associated with such Reward(s) and/or additional costs associated with such Reward(s) and/or its redemption.
14. The participant acknowledges that the Reward is non-exchangeable, non-transferable and not redeemable for purposes other than in accordance with the redemption terms and conditions of a particular Reward, and the Reward cannot be withdrawn in the form of money.
15. The Quiz is valid only during the Quiz Period.
16. All information submitted in connection with this Quiz will be treated in accordance with these Quiz Terms and the Privacy Policy available at https://www.zomato.com/policies/privacy. You agree that Zomato may share the information provided by you with the third party partner brands associated with the Quiz.
17. The winners of the Quiz shall be solely liable to comply with the applicable laws and regulations in order to redeem and/or avail the benefits of the Reward.
18. By participating in the Quiz, you give Zomato and/or its affiliates permission and consent to use your name, likeness, image, voice, appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images and the like, taken or made in relation to the Quiz and also any promotions, events, or contests to follow.
19. The participant acknowledges that the Quiz held on the Zomato Platform are all skill based games and games of skill are excluded from the ambit of Indian gambling legislations including Public Gambling Act of 1867 and other state enactments.
20. This Quiz is being made purely on a ‘best effort’ basis and participating in this Quiz is voluntary. By participating in the Quiz, you will be legally bound hereby, to release from liability, and hold harmless Zomato and any of its affiliates, employees or agents representing or related to Zomato for any matters in relation to the Quiz.
21. Zomato reserves the right to modify these Quiz Terms from time to time or at any time, modify or discontinue, temporarily or permanently, the Quiz and/or these Quiz Terms, with or without prior notice to you and the decision of Zomato shall be final and binding in this regard.
22. These Quiz Terms do not alter in any way the terms or conditions of any other program or arrangement the participant may have with Zomato. Termination of the Quiz and these Quiz Terms shall have no effect on the Terms of Service governing the contractual relationship between the participants and Zomato.
23. The Quiz shall be governed by Indian laws, and the courts of New Delhi shall have exclusive jurisdiction to adjudicate any disputes arising out of or in relation to the Quiz and/or these Quiz Terms.
